Welcome to MyFamilySong.com ("Site"), operated by Aurelian Records, a division of Indigo Company LLC ("Company," "we," "us," or "our"). By accessing or using our Site and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

Overview of Services

MyFamilySong creates original, personalized songs based on information you provide. Our songs are custom-crafted for occasions including but not limited to birthdays, weddings, Mother's Day, Father's Day, anniversaries, memorials, and other life events.

Songs are produced using AI-assisted music generation technology combined with human creative direction, and are distributed to major streaming platforms including Spotify, Apple Music, YouTube Music, Amazon Music, and 150+ additional platforms via our distribution partners.

How It Works

You submit a song request through our order form, providing details about the recipient, the occasion, your story, and your preferences for style and genre. We create an original, personalized song based on your submission. Your completed song is delivered to you digitally via email. Your song is published to major streaming platforms, where it will be available permanently.

Pricing and Payment

All prices are listed in US dollars and are due in full at the time of order. We accept payment via PayPal and major credit/debit cards. Prices are subject to change without notice, but changes will not affect orders already placed and paid for. Current packages and pricing are displayed on our order page at the time of purchase.

Song Creation and Delivery

Delivery Timeline: We aim to deliver your completed song within the 24-48 hours of receiving your order and all required information. Delivery timelines may vary based on order volume and complexity.

Your Responsibility: You are responsible for providing accurate, complete, and appropriate information for your song. We are not responsible for errors in the song that result from incorrect or incomplete information you provide.

Content Standards: We reserve the right to decline any order that requests content that is hateful, defamatory, obscene, promotes violence, infringes on third-party rights, or is otherwise objectionable at our sole discretion.

Revisions: Each order includes one (1) complimentary revision. Revision requests must be submitted within 72 hours of song delivery. Additional revisions may be available for an additional fee. Revisions are limited to adjustments consistent with your original order (e.g., name corrections, minor lyrical changes). Complete re-creations or fundamental style changes are not covered under free revisions.

Intellectual Property and Ownership

THIS IS AN IMPORTANT SECTION. PLEASE READ CAREFULLY.

What We Own: All songs created by MyFamilySong are the intellectual property of Aurelian Records / Indigo Company LLC. We retain full ownership of the master recording, the musical composition (melody, arrangement, and instrumentation), all publishing rights, and all rights to distribute, stream, license, and monetize the song.

What You Receive: When you purchase a song from MyFamilySong, you receive a Personal Use License granting you the right to listen to and enjoy the song personally, share the song with family and friends, post the song on your personal social media accounts, play the song at personal non-commercial events (weddings, birthday parties, family gatherings, memorials), and download and keep a digital copy of the song for personal use.

What You Do NOT Receive: Your purchase does NOT include ownership of the master recording or composition, copyright or publishing rights, the right to upload the song to any streaming platform or distribution service, the right to use the song for any commercial purpose (advertising, business promotion, broadcast, film, etc.), any claim to royalties, streaming revenue, or other income generated by the song, or the right to modify, remix, sample, or create derivative works from the song.

Streaming and Royalties: All songs created by MyFamilySong are published to major streaming platforms under the Aurelian Records artist catalog. All streaming royalties and revenue generated by these songs belong exclusively to Aurelian Records / Indigo Company LLC. By placing an order, you acknowledge and agree that you have no claim to any royalties, revenue, or income generated by your song on any platform, now or in the future, regardless of the song's performance or popularity.

Commercial Licensing: If you wish to use your song for commercial purposes (business advertising, broadcast, film, social media marketing for a business, etc.), please contact us at [email protected] to discuss commercial licensing options. Commercial licenses are available for an additional fee.

Customer-Submitted Content: If you provide specific phrases, names, stories, or other content for inclusion in your song, you grant MyFamilySong / Aurelian Records an irrevocable, worldwide, royalty-free license to use that content in the creation, distribution, and promotion of your song. You represent that any content you submit is your own or that you have the right to share it.

User Conduct

You agree not to provide false or misleading information in your order, submit content that infringes on any third party's intellectual property or privacy rights, use our services for any unlawful purpose, attempt to upload, distribute, or monetize songs created by MyFamilySong as your own work, or resell or commercially exploit songs purchased from MyFamilySong without a commercial license.

Disclaimer of Warranties

Our services are provided "as is" and "as available." While we strive to create beautiful, personalized songs that exceed your expectations, we do not guarantee that every song will match your subjective vision perfectly. Music is a creative endeavor and results may vary. We do not warrant that our services will be uninterrupted, error-free, or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, Aurelian Records / Indigo Company LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific song in question.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. The personal stories and details you share for song creation are used solely for that purpose and are handled with care and discretion.

Third-Party Platforms

MyFamilySong distributes songs through third-party streaming platforms including but not limited to Spotify, Apple Music, YouTube Music, and Amazon Music. We are not affiliated with, endorsed by, or sponsored by any of these platforms. The availability of songs on these platforms is subject to their respective terms and policies, which are beyond our control.

Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our Site. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Maricopa County, Arizona.
